These Terms & Conditions govern the use of the New World Babies Club Website www.newworldbabiesclub.co.nz including the online blog and membership of the the New World Babies Club. Please read them carefully.

By joining the New World Babies Club, using the website and participating in the blog you have acknowledged that you have read and agree to be bound by these Terms and Conditions. Over time these documents may be updated. We encourage you to check them regularly.

1.    Membership
1.1.    Membership of the New World Babies Club is open to all New Zealand residents.
1.2.    Your right to use the member’s areas of the website and offers is personal to you. You may not authorise others to use your login details.
1.3.    New World Babies Club discount offers and competitions are only available in the region(s) stated (for example Upper North Island, lower North Island or South Island of New Zealand).
1.4.    Applicants must be an existing Fly Buys member to join the New World Babies Club.
1.5.    Membership of the New World Babies Club is available to eligible persons free of charge.
1.6.    Only natural persons may be Members.
1.7.    New World Babies Club may change, at any time and without prior notice, these Terms and Conditions. New World Babies Club may make that change even if it has the effect of reducing or extinguishing the number or value of, or the period for expiry of, any existing or future benefits of the membership. New World Babies Club will attempt to notify Members of any changes.
1.8.    Notice shall be deemed to be given by New World Babies Club to a member if it is posted or emailed to the physical or email address of the Member appearing in the New World New Babies Club records.
1.9.    New World Babies Club reserves the right to suspend or terminate the New World Babies Club programme at any time without prior notice.
1.10.    New World Babies Club is not liable for:
1.10.1.    any loss, theft or damage to any reward in the course of post or delivery
1.10.2.    any failure to notify Members of any changes in these Terms and Conditions
1.10.3.    suspension and/or termination of the New World New Babies Club programme
1.11.    All conditions and warranties, whether express or implied and whether arising under legalisation or otherwise, as to the condition, suitability, quality, fitness or safety of any goods or services under the New World Babies Club programme are expressly excluded to the full extent permitted by law.
1.12.    New World Babies Club may terminate a membership of the New World Babies Club, without notice and for any reason, including but not limited to:
1.12.1.    failing to comply with these Terms and Conditions
1.12.2.    supplying any misleading information or making any misrepresentations to New World Babies Club or to any participating company in connection with the New World Babies Club;
1.12.3.    abusing any privilege accorded to the Member under the New World Babies Club
1.12.4.    fraudulent use of discount coupons including presenting single use coupons on multiple occasions, passing coupons onto non-members, attempting to use multiple coupons in a single transaction,. dissclosing member login and password details to non-members.
1.12.5      New World Babies Club is not required to disclose the reason for termination membership.
1.13.    At times discount coupons will be sent to Babies Club members to be redeemed for money off products or for Fly Buys Bonus Points in New World stores. These coupons are to be printed once for single use by a member. The Terms and Conditions of each coupon will be clearly stated and it's the member's responsibility to check these and comply. Multiple printing and usage of these coupons will result in termination of membership.
1.14.    A Member may at any time terminate his or her membership via the Babies Club website (select the My Babies Club option then select Update My Profile), or by giving written notice to New World via babiesclub@newworld.co.nz
2.    Content
2.1.    The contents of this website have been prepared in accordance with New Zealand law. The contents of this website and any contracts formed with the New World Babies Club are governed by New Zealand law and New Zealand courts have exclusive jurisdiction.
2.2.    The New World Babies Club website contains copyrighted materials, trademarks and other proprietary information and the entire contents of the website are copyrighted as a collective work. Materials on this website or downloaded by you are for your personal use only.
2.3.    New World Babies Club will post regular information and recipes. Whilst every effort is made to ensure the accuracy of information, the New World Babies Club will not be held responsible for any errors or inaccuracies resulting in unforeseen consequences.
2.4.    This website is not intended to provide in-depth professional advice and information is of a general nature only. If you wish to research a topic in more depth for yor personal situation please seek specific advice and information directly from a qualified professional.

3.    Blog / forum
3.1.    You are responsible for ensuring any information or material you post to the Babies Club website does not violate any copyright  or other personal or proprietary rights of any third party, and it may be used for all purposes reasonably associated with the Babies Club website free from copyright or other restrictions.
3.2.    You agree not to use obscene or offensive language or to submit any material that is, or may potentially be, defamatory, abusive or hateful, an invasion of anyone’s privacy, harmful to other users, harmful to the business interests of New World, or encourages conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any local, national or international law or regulation.
3.3.    We ask that you avoid criticism of named products, individuals, corporate identities or health practitioners in the blog.
3.4.    Members are not permitted to post any information to the blog using multiple usernames to login.
3.5.    You agree not to submit or post any material which constitutes junk mail or unauthorised advertising without the prior written consent to the New World Babies Club. The website and blog are only to be used for lawful purposes.
3.6.    New World reserves the right to delete or modify any post without prejudice or explanation, if deemed to conflict with these Terms & Conditions.
3.7.    The Babies Club reserves the right to take such action as deemed necessary if users misuse the website or fail to abide by these Terms & Conditions, such as expulsion from the Club or suspending access to the website.
3.8.    The New World Babies Club does not necessarily endorse, support, sanction, verify or agree with the comments, opinions, materials or statements made or supplied by users of the blog. Therefore any opinion, advice or other information so expressed should not be relied upon.
3.9.    You agree the Babies Club is not responsible and shall have no liability to you with respect to any material posted or supplied by others. You release the New World Babies Club from any and all liability for all claims related to content and any other items obtained on or through the website, as well as to the security level of privacy provided.

4.    Privacy Policy
This Privacy Policy discloses New World Babies Club information gathering and dissemination practices. Personal information is any information that can be used to identify you. The New World Babies Club will take all reasonable steps to maintain the security and integrity of your personal information. The club does not collect information from members unless it is provided knowingly and voluntarily.
Every time we collect or deal with yor personal information we will comply with the New Zealand Privacy Act.
4.1.    Information provided to New World Babies Club or by participating companies, will be collected by New World Babies Club and held at a secure database management provider.
4.2.    Information collected will be used by New World Babies Club, its agents and service providers for the purpose of providing and obtaining offers and services relating to the New World Babies Club programme.
4.3.    Information from the database will also be used by New World for marketing purposes, planning, product development and research.
4.4.    Each member consents to the collection and use of their personal and other information in the manner set out above and the disclosure of such information to New World Babies Club agents and reward providers for the purpose of operating the New World Babies Club.

5.    Important Email Security Notice
5.1.    Please note that New World Babies Club will never send you an email asking you to disclose your Member Number or any other personal details.
5.2.    A legitimate email from New World Babies Club will always contain some of your personal details such as your first name and last name, or your Fly Buys Member Number.
5.3.    If you are ever in any doubt about the authenticity of any communications that are or seem to be from New World Babies Club please immediately email babiesclub@newworld.co.nz
